Acceptable Use Policy

This Acceptable Use Policy sets out what you may and may not do with the SwayByte Services. It is incorporated into our Terms of Service, and breaching it is a breach of those Terms.

SwayByte is owned and operated by OmniRogue.com (OmniRogue Inc.). This Policy applies to every user, seat, partner, reseller and connected account.

1. Prohibited Content and Activity

You must not use the Services to create, upload, generate, store or distribute content, or to engage in activity, that:

  • sexualises minors in any way, or depicts, promotes or facilitates child sexual abuse;
  • is non-consensual intimate imagery, or sexual content depicting a real identifiable person without that person's explicit consent;
  • depicts or generates the voice, face or likeness of a real person without the rights or consent required, including for deceptive endorsement, impersonation or fraud;
  • impersonates any person, company, brand or public official, or falsely suggests affiliation or endorsement;
  • is designed to deceive — disinformation, fabricated news, forged documents, fake reviews, manipulated evidence, or synthetic media about real events or people presented as genuine;
  • facilitates fraud, scams, phishing, identity theft, money laundering, or the sale of stolen credentials or data;
  • harasses, bullies, threatens, defames, or promotes violence, self-harm, terrorism or hatred against a person or group;
  • provides instructions for weapons, explosives, biological, chemical, radiological or nuclear harm, or for attacking critical infrastructure;
  • constitutes malware, ransomware, exploit code, or tooling intended to compromise systems, evade detection or conduct unauthorised access;
  • infringes copyright, trademark, patent, trade secret, publicity or privacy rights;
  • violates applicable law, sanctions or export controls, or is generated for use in a sanctioned jurisdiction or by a sanctioned party;
  • markets regulated products or services unlawfully, including unlicensed financial, medical, pharmaceutical, gambling or adult offerings.

2. AI Safety, Moderation and Content Filtering

The Services apply automated safety classifiers, prompt filtering and output filtering, supplemented by human review where necessary. A request may be blocked, delayed or refused, and generated output may be withheld or removed, where it appears to breach this Policy, applicable law, or the usage policies of an underlying model provider.

These systems are imperfect and produce both false positives and false negatives. Do not attempt to circumvent them, including through prompt injection, obfuscation, encoding, role-play framing, incremental elicitation, or by splitting a prohibited request across multiple jobs or accounts. Circumvention attempts are themselves a breach of this Policy.

Credits consumed by a job blocked by moderation are restored to your balance.

3. Fair Use, Rate Limits and Platform Safeguards

All plans are subject to fair use, rate limits, concurrency limits, queue prioritisation and per-job size and duration limits necessary to keep the platform available to every customer.

You must not run automated or scripted traffic against the Services outside a documented interface, scrape the Services, stress or load test them without written permission, circumvent metering or billing, or operate multiple accounts to evade limits, trials or enforcement.

3.1 Unlimited features, model access and rate limits

Where a feature is described as unlimited, that means no fixed monthly cap for ordinary individual use. It does not mean unmetered infrastructure, guaranteed throughput, unlimited concurrency, or permission to resell capacity. Usage materially beyond ordinary individual use may be rate limited, de-prioritised, or required to move to an appropriate plan.

4. Account Security and User Responsibility

You are responsible for everything done through your account. Keep your credentials confidential, do not share seats between individuals, and notify us immediately at the support address if you suspect unauthorised access.

You must not access another user's account, probe or test the vulnerability of the Services without written authorisation, or interfere with the operation of the platform for other users.

5. White-Label, Reseller, Affiliate and Connected-Account Use

Partners are responsible for the conduct of the end customers they onboard, and must enforce terms at least as protective as this Policy.

Partners must accurately describe what is being sold and at what price, publish working contact, cancellation and refund information, honour cancellations and lawful refund requests, and must not misrepresent their relationship with SwayByte or OmniRogue Inc.

Excessive disputes, fraud, or policy violations originating from a partner's customers may result in payout holds, restriction or termination.

6. Enforcement

Where we identify a breach we may, proportionate to the circumstances and without prior notice where the risk requires it: remove or restrict access to content; apply rate limits or reduce queue priority; restrict or disable specific features; suspend or terminate the account and any linked accounts; withhold partner payouts; retain evidence; and report the matter to law enforcement or a relevant authority where legally required or appropriate.

Accounts terminated for a serious breach — in particular content involving minors, non-consensual intimate imagery, or fraud — are not eligible for a refund, and we may decline to provide the Services to the same person or business in future.

7. Reporting Violations

To report content or activity that breaches this Policy, email support@swaybyte.com with the subject line “AUP Report”. Please include links or identifiers, a description of the issue and any evidence you can share.

Reports concerning child safety are prioritised and actioned immediately. Copyright owners may submit an infringement notice to the same address.

8. Updates to This Policy

We may update this Policy as the Services, the law and provider requirements change. The effective date at the top of this page shows when it was last revised. Material changes are notified by email or by prominent notice in the Services.
