Data Deletion Requests

You can ask us to delete the personal data we hold about you at any time, whether or not you have an active subscription. This page explains how to make that request, what happens to your data, and what we are required to keep.

SwayByte is owned and operated by OmniRogue.com (OmniRogue Inc.). Deletion requests are handled by OmniRogue Inc. as data controller. Send yours to support@swaybyte.com with the subject line “Data Deletion Request”.

1. How to Submit a Request

Email support@swaybyte.com from the address associated with your account, with the subject line Data Deletion Request, and tell us whether you want:

  • Full account deletion — your account, User Content, generated output and profile data; or
  • Partial deletion — specific content, projects or assets, which you should identify as precisely as you can.

If you have an active subscription, please also tell us whether you want it cancelled. Deleting an account does not by itself stop a subscription billed through a third party, and cancelling a subscription does not by itself delete your data — ask for both if you want both.

2. Verification

To protect your account we verify that a request genuinely comes from you. Requests sent from the account email address are normally sufficient. Where the request comes from another address, or covers a large volume of data, we may ask for additional information to confirm your identity. We use anything you provide for verification only, and delete it once verification is complete.

An authorised agent may submit a request on your behalf with written proof of authorisation.

3. What Happens and When

  • We acknowledge your request within 1–3 business days.
  • Verified requests are completed within 30 days — or 45 days for requests under the CCPA where an extension is needed and you are notified.
  • Your account and content are removed from active production systems on completion.
  • Encrypted backups are purged on their normal rotation, within 35 days of deletion from production. Backup copies are not restored to active use in the interim.
  • We confirm in writing once the deletion is complete.

4. What We Must Retain

Some records cannot be deleted on request because we are legally required to keep them, or need them to establish or defend legal claims:

  • Billing and transaction records — retained for the period required by tax and accounting law, typically seven years. These are retained in finance systems only and are not used to contact you.
  • Fraud, abuse and security records — a minimal record of accounts terminated for a serious breach of our Acceptable Use Policy, retained to prevent recurrence.
  • Records subject to a legal hold — where litigation, an investigation or a lawful order requires preservation.

Everything outside these categories is deleted or irreversibly anonymised.

5. Third-Party Processors

On deletion we instruct our subprocessors to delete the personal data they hold on our behalf, in accordance with our agreements with them. Payment processors retain transaction records independently under their own legal obligations, and those records are governed by the processor's privacy policy.

6. Other Data Rights

As well as deletion, you may request access to the personal data we hold about you, correction of inaccurate data, a portable copy of your data, or restriction of or objection to processing. Use the same address and describe what you need. Your full set of rights is described in our Privacy Policy.

If you are in the EEA or the UK, you also have the right to complain to your local data protection supervisory authority.
